US Drone Market Faces New Rules as Commercial UAV Expo Breaks Records
A record 3,800 commercial drone professionals gathered in Las Vegas for Commercial UAV Expo 2026 at an unusually consequential moment for the American unmanned aircraft market. On the final day of the event, a new US tariff regime took effect that can impose duties of 100% on certain imported unmanned aircraft, docking stations and critical components.
It was an unusually literal collision between conference discussion and commercial reality. While operators, manufacturers and regulators were debating beyond visual line of sight operations, supply chains and procurement inside Caesars Forum, the economics of importing some of the equipment used by the industry were changing outside it.

Regulation Moves Towards Routine BVLOS Operations
Much of the commercial potential attached to drones has long depended on overcoming a straightforward operational limitation: keeping the aircraft within visual line of sight.
Inspection of linear infrastructure, pipelines, transmission networks, highways, railways and large construction projects becomes considerably more useful when an aircraft can operate over meaningful distances without requiring observers to maintain direct visual contact. The same applies to drone delivery, agricultural operations and persistent monitoring.
The FAA’s proposed Part 108 framework is intended to establish performance-based regulations for low-altitude BVLOS operations rather than continuing to rely principally on individual exemptions and waivers. The proposal encompasses applications including package delivery, agriculture, aerial surveying, civic operations, training, testing and other commercial uses. Part 146 would sit alongside that framework by regulating third-party service providers supporting Part 108 operations, including automated data services associated with UAS Traffic Management.
The rulemaking remains unfinished. The original comment period closed in October 2025 after the FAA received approximately 3,100 comments, with substantial industry interest around detect-and-avoid, electronic conspicuity and right-of-way requirements. The agency subsequently reopened comments for a limited period in early 2026 to examine some of those questions further.
That unfinished regulatory architecture gave Commercial UAV Expo a different character from a conventional technology exhibition. FAA officials participated throughout the three days, while European Union Aviation Safety Agency representatives discussed the European regulatory position. The two organisations came together for the final-day keynote, “Two Skies, One Conversation”, comparing approaches to BVLOS operations on either side of the Atlantic. The discussion featured Robert Reckert, FAA Acting Division Manager for the Emerging Technologies Division within Flight Standards, and Daan Dousi, EASA Head of Department for Innovative Air Mobility.
Manufacturers, software developers, communications providers, detect-and-avoid specialists, fleet management platforms and insurers all have a stake in the development of scalable BVLOS operations. Aircraft travelling beyond direct visual observation increasingly depend upon a supporting network of communications, positioning, traffic information and automated systems.
Procurement Becomes Part of the Drone Business
Regulation is only one part of the changing US market. The FCC’s December 2025 decision to add foreign-produced UAS and critical components to its Covered List introduced another consideration into equipment selection and supply-chain planning.
Commercial drone procurement increasingly involves questions about component origin, communications security, regulatory eligibility and future availability alongside familiar considerations such as payload, endurance, reliability and price. For organisations operating drones over infrastructure or other sensitive assets, a platform purchased today may be expected to remain operational for years, making the availability of replacement aircraft, batteries, communications equipment and other components part of the purchasing decision.
Manufacturers must increasingly demonstrate where equipment and critical technology originate, while operators need confidence that a fleet can remain compliant and supportable throughout its working life.
A New US Tariff Structure
The most immediate commercial change arrived during the Expo itself, when new Section 232 measures covering unmanned aircraft systems and components became effective at 12:01am Eastern Time on September 3. The measures followed a US Department of Commerce investigation into the national-security implications of UAS imports.
The resulting tariff structure is more complicated than a blanket duty on foreign drones. Specified UAS with a maximum take-off weight above 25 kg, aircraft integrating thermal imagers, UAS docking stations and certain critical components can face an additional 100% ad valorem duty. Specified UAS weighing 25 kg or less without thermal imaging are generally subject to a 25% rate, although the proclamation contains exceptions, preferential treatment and delayed implementation provisions.
Products meeting specified conditions from the European Union, Japan, South Korea, Taiwan, Switzerland and Liechtenstein can face a rate no higher than 15%, while qualifying UK products can be limited to 10%. Those provisions depend upon certification requirements covering the origin of critical components and technology.
Certain UAS components covered separately by the measure are scheduled for a 25% duty from February 9, 2027. The framework also establishes an incentive programme for companies investing in new US production capacity and transitional arrangements for some products already covered by specified government programmes.
The measures therefore affect both import costs and manufacturing decisions. For commercial operators, two technically comparable platforms may carry substantially different landed costs depending upon their weight, configuration, component origin and manufacturing arrangements.
Aircraft, Sensors and Operational Systems
More than 250 companies presented aircraft, sensors, software and services on the exhibition floor, illustrating how widely the commercial drone ecosystem has expanded beyond the airframe.
AgEagle Aerial Systems introduced its EagleNXT Altum-PT Pro sensor, while A2Z Drone Delivery presented its Longtail Dual multi-mission BVLOS platform. Harris Aerial, Skyline Nav AI and UtopiaCompression Corporation were selected as the 2026 winners of the event’s Pitch the Press competition.
Across more than 50 conference sessions involving over 140 speakers, the programme covered BVLOS implementation, artificial intelligence, autonomy, workforce development and operational applications across energy, utilities, construction, transportation and enterprise drone programmes. The opening keynote also presented findings from the 2026 State of the Industry Survey conducted by Commercial UAV News and Pilot Institute.
Many of these applications now depend upon complete operational systems rather than isolated aircraft. Sensors, positioning, communications, data processing, fleet management, airspace information and automated workflows increasingly operate as parts of the same system, particularly as aircraft travel farther from the operator.
Public Safety Operations Scale Up
Public safety provided one of the clearest examples of established operational use. The DRONERESPONDERS Public Safety Summit, presented by AIRT, ran across two days, while a new DRONERESPONDERS Program Management Course sold out its limited capacity.
The Eric Talley Public Safety UAS Excellence Award was presented to Greg Whiting, technology integration cell director and sUAS programme manager for the Texas Military Department, whose programme had completed its 100,000th sortie the day before the award was presented.
Public safety, surveying, inspection and asset management already contain mature drone deployments operating well beyond occasional demonstration flights. The challenge increasingly involves scaling those programmes, integrating them with regulated airspace and maintaining fleets as technical and regulatory requirements develop.
The Pilot Hub, presented by Pilot Institute, added eight practitioner-led sessions available to registered attendees, while the Indoor Airspace Demonstration Area returned with live educational demonstrations.
From Aircraft to Infrastructure
Commercial UAV Expo 2026 reflected an industry whose challenges are becoming less about demonstrating whether drones can perform useful work and increasingly about building the regulatory, technological and industrial systems required to operate them at scale.
Part 108 could provide a more predictable route towards routine BVLOS operations, while procurement requirements and the new tariff structure add further considerations around equipment origin, availability and cost. For manufacturers and operators, those developments are arriving while aircraft, sensors and autonomous systems continue to advance.
Against that background, the record turnout in Las Vegas looks less like a straightforward measure of enthusiasm for drones than evidence of an industry with a growing number of decisions to make.
